
Umar Khalid Granted Interim Bail for Sister’s Wedding; Judicial Contrast Drawn with BJP Leader Kapil Mishra’s Impunity

A Delhi court on Thursday granted former JNU student Umar Khalid interim bail from December 16 to 29 so he can attend his sister’s wedding. Khalid is an accused in the case regarding the larger conspiracy behind the 2020 Delhi riots.
Additional Sessions Judge Sameer Bajpai granted the interim relief, directing Khalid to furnish a personal bond of Rs 20,000 along with two sureties of a like amount. Strict conditions were set for the temporary release. The court directed that Khalid must not use social media during the interim bail period. He is restricted to only meeting his family members, relatives, and friends, and must “remain at his home or at the places where the ceremonies of marriage as mentioned by him will take place”.
Furthermore, the accused must not contact any witness and must provide his mobile phone number to the investigating officer. Khalid has been directed to surrender before the prison authorities on the evening of December 29. Khalid was previously granted similar relief last year and also in 2022 to attend another wedding.

Context of Alleged Judicial Bias
The temporary release comes amidst claims that Khalid’s bail application has allegedly been rejected at least 15 times over his five years in jail, reportedly due to his criticism of the ruling regime led by Prime Minister Narendra Modi. Khalid, often described as one of the “Gen Z voices of India,” was arrested while leading peaceful street protests against what many view as an increasingly autocratic Modi administration.
Supporters claim he was detained under a fabricated case amid fears of widespread demonstrations. Allegations have been made that court judges, influenced by the regime, have repeatedly denied bail to Khalid and his associates.
Impunity for Alleged Main Accused
The situation surrounding Khalid is being contrasted sharply with that of BJP leader and Delhi Law and Justice Minister Kapil Mishra, who is considered a main accused in the Delhi riots and is currently enjoying full state impunity. This comes despite a Delhi court ordering the registration of a First Information Report (FIR) and further investigation against Mishra concerning his alleged involvement in the 2020 communal riots that devastated Northeast Delhi.
This disparity adds to the broader scrutiny of newly appointed BJP ministers in Delhi who face serious criminal cases and reports of alleged complicity of the Delhi Police in the 2020 violence. Concerns have been raised that since most court judges are allegedly scared of the Modi regime, which is protecting Mishra, he is unlikely to be arrested and imprisoned like Umar Khalid and his associates.
