The Ascent of DK Shivakumar: New Karnataka CM Faces Legal Reckoning Over Disproportionate Assets

DK Shivakumar has officially assumed the role of Karnataka Chief Minister following a long-awaited leadership rotation within the Congress party. Despite his political victory, he remains embroiled in a high-stakes ₹74.93 crore disproportionate assets case that continues to face scrutiny from the Supreme Court and the Central Bureau of Investigation (CBI).

DK Shivakumar, long recognized as one of the Congress party’s most influential leaders in South India, took the oath as the Chief Minister of Karnataka today. This transition follows a protracted two-year leadership struggle, which eventually saw the Congress high command move Siddaramaiah out of the top post to fulfill a 2023 promise regarding a rotating Chief Ministership. However, Shivakumar’s elevation comes at a time when his financial dealings are under intense legal pressure.

The Central Bureau of Investigation (CBI) is currently investigating allegations that Shivakumar amassed wealth totaling ₹74.93 crore, which is reportedly disproportionate to his known sources of income during his tenure as a state minister between 2013 and 2018. This legal cloud darkened further in July 2024 when the Supreme Court of India dismissed Shivakumar’s petition to quash the CBI’s First Information Report (FIR). A bench of Justices Bela M. Trivedi and S. C. Sharma refused to interfere with a prior Karnataka High Court order, ensuring the investigation continues to loom over his administration.

The scale of Shivakumar’s wealth has been a point of public and legal contention. In his election affidavit, he declared combined assets exceeding ₹1,413 crore, positioning him as one of the wealthiest legislators in India. This massive accumulation has prompted activist and journalist, Rakesh Raman of RMN News, to petition various high-level bodies—including the Prime Minister’s Office (PMO), the Lokpal, and the Karnataka Lokayukta—to demand a thorough investigation into the origin of these funds. The RTI applications have sought to uncover the status of these internal government investigations, amid concerns that such high-profile political corruption cases are often suppressed.

Shivakumar’s legal history is marked by significant prior encounters with federal agencies. In 2019, he was arrested by the Enforcement Directorate (ED) in a money-laundering case involving alleged tax evasion and hawala transactions. While he spent time in Tihar Jail before securing bail in October 2019, the Supreme Court eventually dismissed the ED’s proceedings in March 2024 on technical grounds related to the Prevention of Money Laundering Act (PMLA).

Despite these legal reprieve, Shivakumar remains featured in the India Corruption Research Report (ICRR) 2025. The report critically notes a trend where politicians facing serious accusations of financial crimes utilize bail as a “virtual acquittal,” rarely returning to face further incarceration. As he takes the helm of the Karnataka government, the tension between Shivakumar’s political power and his legal ledger remains a defining feature of the state’s political landscape.
