Justice Yashwant Varma of the Allahabad High Court has taken his fight to the Supreme Court, challenging the findings of an enquiry committee that recommended impeachment proceedings against him. The move comes after a significant sum of cash was recovered from his residence, sparking a major controversy surrounding judicial integrity in India.
The Heart of the Challenge: Rights Violations and Burden of Proof
In his petition, Justice Varma seeks to quash the three-judge enquiry committee’s report, arguing that the proceedings infringed upon his fundamental rights as both an individual and a constitutional functionary. He has also urged the Supreme Court to set aside the impeachment recommendation made by former Chief Justice of India Sanjiv Khanna, which was based on the committee’s conclusions.
Justice Varma contends that the enquiry committee concluded its investigation without thoroughly examining crucial facts. He further alleges that the committee erroneously shifted the burden of proof onto him, forcing him to disprove facts that were merely presumed to be true.
Impeachment Looms as Parliament Session Nears
Media reports indicate that Justice Varma’s petition was filed just days before the Monsoon Session of Parliament, scheduled from July 21 to August 21, 2025. During this session, the Centre is widely expected to table an impeachment motion against the High Court judge.
The Supreme Court recently agreed to hear a separate petition calling for the Delhi Police and Enforcement Directorate to register an FIR and conduct a thorough investigation into the cash discovery at Justice Varma’s residence. This plea asserts that the discovery of such unaccounted currency constitutes a “culpable and cognisable offence” and that law enforcement agencies are duty-bound to act.
Judicial Corruption Under the Scanner: A Wider Problem?
The incident involving Justice Varma has intensified public scrutiny of judicial corruption in India. Many believe that a pervasive culture of bribery exists within the Indian judiciary, where judges allegedly accept illicit payments to deliver favorable judgments. The practice of “bribe for bail” is widely perceived to have become normalized.
Speculation is rife that Justice Varma may have been holding bribe money for several other judges. Furthermore, senior lawyers, particularly those with political affiliations, face accusations of acting as intermediaries between influential politicians and judges to secure bail for their clients. These lawyers are often seen defending accused judges in public, further fueling concerns about their complicity in bribery.
The fact that high-profile politicians such as Rahul Gandhi, Sonia Gandhi, P. Chidambaram, D.K. Shivakumar, Hemant Soren, Arvind Kejriwal, and Manish Sisodia, despite facing “grave allegations,” are all out on bail, is frequently cited as evidence of a distorted justice system in India.

The recovery of a large amount of unaccounted cash at Justice Varma’s home, allegedly bribe money for various judges, and the recent transfer of a Special Judge (PC Act) following a bribery case against his record keeper, are seen as stark indicators of this systemic judicial decay. The alarming trend of granting bail to influential politicians accused of serious financial crimes has become a national embarrassment, with bail often leading to a “virtual acquittal” as they rarely return to jail.
When these politicians are arrested, they frequently orchestrate protests with paid demonstrators to create a narrative of political victimization or fabricated charges. The India Corruption Research Report 2024 and India Judicial Research Report 2024 reportedly detail the entrenched corruption across India’s bureaucracy, political class, and judiciary, painting a picture of a nation held captive by its criminal elite.
The Fire, The Cash, and The Denial
In March 2025, a fire at Justice Yashwant Varma’s official residence in Delhi led to the discovery of a large amount of burnt or partially burnt cash, igniting a major public debate. At the time, he was a judge of the Delhi High Court.
Justice Varma has vehemently denied any knowledge of the cash, asserting that neither he nor his family placed it there. He has consistently maintained that the entire episode is a “conspiracy” aimed at framing and defaming him.
Following the incident, then Chief Justice of India Sanjiv Khanna initiated an in-house enquiry through a three-member committee of judges. The committee’s report reportedly concluded that Justice Varma was liable for misconduct, citing “strong inferential evidence” of his “covert or active control” over the storeroom where the cash was found. The report also noted his failure to provide a credible explanation for the source of the funds.
Based on these findings, the Chief Justice reportedly recommended initiating impeachment proceedings. Justice Varma was advised to resign or opt for voluntary retirement, but he refused, stating that such actions would imply acceptance of a “fundamentally unjust” process.
Justice Varma was subsequently transferred from the Delhi High Court to the Allahabad High Court, his parent court, and stripped of all judicial duties. An impeachment motion against him is anticipated to be introduced during the upcoming Monsoon session of Parliament.
