OpenAI Launches Lawsuit Against Elon Musk Alleging “Bad-Faith Tactics”

The lawsuit filed by OpenAI against Elon Musk underscores the intense competition in the field of artificial intelligence. 

The legal battle is seemingly set for a protracted period.

Mr Musk’s central contention is that OpenAI has deviated from its original non-profit mission, which was to develop AI for the benefit of humanity.

OpenAI has initiated legal action against Elon Musk, co-founder of the artificial intelligence research and deployment company who departed several years ago, accusing him of engaging in “nonstop” efforts to impede its business for his own gain. 

The company asserts that the Tesla boss is employing “bad-faith tactics” directed at OpenAI with the objective of securing control over leading-edge AI technology. This countersuit represents a new escalation in the intense rivalry between two prominent entities in Silicon Valley.

In a statement released on Wednesday, OpenAI declared, “Elon’s nonstop actions against us are just bad-faith tactics to slow down OpenAI and seize control of the leading AI innovations for his personal benefit,”.

The company further stated, “Today, we countersued to stop him,”. This legal move comes after Mr Musk himself sued OpenAI chief executive Sam Altman in the previous year, attempting to prevent changes to the company’s corporate structure. The BBC has sought a response from Mr Musk’s lawyer regarding OpenAI’s lawsuit, which was officially filed on Wednesday (April 9).

The legal battle is seemingly set for a protracted period, with a federal judge in Oakland, California, having scheduled a trial date for Mr Musk’s initial lawsuit for March 2026, aiming to expedite the legal proceedings. 

Previously, US District Judge Yvonne Gonzalez Rogers had rejected Mr Musk’s request for an injunction that would have temporarily halted OpenAI’s transition from a non-profit to a for-profit entity. Moreover, Judge Gonzalez Rogers indicated that she anticipates Mr Musk will be required to provide testimony in the case.

Mr Musk’s central contention is that OpenAI has deviated from its original non-profit mission, which was to develop AI for the benefit of humanity, and is therefore in violation of contract. He officially left the company in 2018. 

OpenAI has also publicly accused Mr Musk of disseminating false information about the company. In a post on X on Wednesday, OpenAI stated, “Elon’s never been about the mission. He’s always been about his own agenda,”. It is noteworthy that Mr Musk’s own AI venture, xAI, stands as a competitor to OpenAI, although it has reportedly lagged behind in development. In the preceding month, xAI acquired Mr Musk’s social media platform, X, formerly known as Twitter. Mr Musk claims that the combined entity, XAI Holdings, boasts a valuation exceeding $100 billion.

Adding another layer to the complex relationship, it was revealed that in February, Mr Musk made an unsolicited offer to acquire OpenAI for a substantial sum of $97.4 billion. This bid was promptly rejected by Sam Altman, who responded with a counter-offer, posting: “no thank you but we will buy twitter for $9.74 billion if you want,”.

The lawsuit filed by OpenAI against Elon Musk underscores the intense competition and diverging visions within the rapidly evolving field of artificial intelligence. The accusations of bad faith and the underlying battle for control highlight the significant stakes involved in the development and deployment of cutting-edge AI technologies. 

This legal confrontation between two influential figures in the tech world is likely to continue drawing considerable attention as it progresses through the courts.
