Mamata Banerjee Defies Election Results, Refuses Resignation Amidst Allegations of Massive “Vote Loot”

TMC leadership has raised specific technical concerns regarding Electronic Voting Machine (EVM) integrity.

Following a massive defeat to the Bharatiya Janata Party (BJP) in the West Bengal assembly elections, Chief Minister Mamata Banerjee has refused to resign, triggering an unprecedented constitutional crisis. Banerjee, whose Trinamool Congress (TMC) held power for three consecutive terms, declared at a press conference that she would not go to Raj Bhavan to tender her resignation because she believes the election mandate was the result of a “loot” rather than a true public choice. The BJP secured 207 seats compared to the TMC’s 80, yet Banerjee insists the election was “stolen” through a conspiracy involving the Election Commission and direct government interference.

Allegations of EVM Swapping and Technical Fraud

TMC leadership has raised specific technical concerns regarding Electronic Voting Machine (EVM) integrity. General Secretary Abhishek Banerjee alleged that EVM units were swapped, noting that serial numbers on machines at counting tables did not match the official records listed in Form 17C. He further highlighted a suspicious anomaly where 90% of the machines maintained a 92–95% battery charge despite being used for 12 hours, a feat he suggested is practically impossible.

Beyond technical discrepancies, the TMC alleged that their counting agents were forcibly removed or driven away through violence from several centres after 2:00 pm. Abhishek Banerjee claimed this was a strategic move to “manufacture an atmosphere” suggesting a BJP lead while as many as 24 rounds of vote counting remained pending in some areas.

Personal Assault and Political Fallout

The personal stakes of this election were high, as Mamata Banerjee lost her own seat in Bhabanipur to her former aide-turned-BJP-rival, Suvendu Adhikari. During her announcement, Banerjee alleged she was physically assaulted and misbehaved with at a counting station, claiming she was “kicked in the belly and back” while CCTV cameras were turned off. She stated that she is currently at her “fighting best” and promised to fight back like a “tiger cub”. To address these issues, the TMC is forming a fact-finding committee composed of five MPs to investigate discrepancies and instances where party offices were vandalized.

Broader Crisis of Democratic Integrity

This local crisis reflects a broader national concern regarding Indian electoral integrity. Opposition leader Rahul Gandhi has backed Banerjee’s claims, stating that the “theft” of mandates in Bengal and Assam is a step toward destroying Indian democracy. Reports from the V-Dem Institute in 2026 have officially reclassified India as an “electoral autocracy,” citing a systematic dismantling of democratic institutions.

Other sources suggest that the Modi regime uses aggressive campaigning as a “smokescreen” to hide EVM frauds, allegedly allowing minor opposition wins in some states only to maintain a facade of competition—a strategy compared by some analysts to a “North Korean Model“. There are also reports of “fraudulent peaks” in voting speeds in other states, such as recorded votes occurring every 6 seconds, which is a physical impossibility for the machines.

The Path Ahead

With the current assembly term ending on May 7, 2026, the state faces an immediate deadline for government formation. While Banerjee’s refusal to step down could theoretically lead to President’s Rule, Election Commission sources indicate this may not be required if the winning party (BJP) stakes its claim and is invited by the Governor to form a government before the term expires. For now, Banerjee remains defiant, stating, “I have not lost, so I will not go to Raj Bhavan”.
