
Trump Administration Overhauls Immigration: High-Skilled H-1B Selection and “Gold Card” Path to Citizenship Launched

The Department of Homeland Security is officially amending the H-1B work visa selection process, moving away from a random lottery to a weighted selection system that prioritizes higher-skilled and higher-paid individuals. This regulatory shift is designed to protect the wages and working conditions of American workers while incentivizing U.S. employers to seek out top-tier foreign talent.
By replacing the old lottery, which officials claim was often exploited by employers seeking low-cost foreign labor, the new rule aims to strengthen America’s competitiveness and ensure the program serves its original intent.
New Standards and Financial Requirements: The annual limit for H-1B visas remains at 65,000, with an additional 20,000 reserved for holders of advanced degrees from U.S. institutions. Under the new weighted process, the probability of obtaining a visa will increase for those at higher wage levels, though employers may still petition for workers across all pay scales. This final rule is scheduled to take effect on February 27, 2026, and will be implemented for the FY 2027 registration season.
To further protect the domestic labor market, the administration has introduced additional hurdles for employers, including a requirement to pay a $100,000 fee per visa as a condition of eligibility. These changes are part of a broader “America First” strategy intended to prevent the undercutting of the American workforce.
