The ongoing controversy has cast a harsh light on the alleged “bribe for bail” culture and the purported role of senior lawyers as intermediaries in securing favorable judicial outcomes.
Union Minister Rijiju Addresses Judicial Corruption
In an exclusive interview with PTI, Union Minister Kiren Rijiju emphasized the gravity of corruption within the judiciary, stating, “Corruption in the judiciary is an extremely sensitive and serious matter, because the judiciary is where people get justice. If there is corruption in the judiciary, it is a serious concern for everybody.”
He highlighted the broad political consensus required for the motion of removal against Justice Yashwant Varma, noting his coordination with leaders across political parties to ensure a “unified stand of the Parliament of India.” Rijiju expressed satisfaction that the Congress party has also agreed to support the motion, asserting that “no party can be seen to be standing with a corrupt judge or protecting a corrupt judge.”
Sibal’s Stance and Rijiju’s Counter
The parliamentary affairs minister also sharply criticized senior advocate Kapil Sibal, dismissing him as an “average lawyer” driven by a “personal agenda.” This came in response to Sibal’s assertion that the opposition should not support the impeachment motion against Justice Varma until an inquiry is initiated against Justice Shekhar Yadav for allegedly making “communal” remarks. Rijiju accused Sibal of attempting to “protect somebody and to move against somebody,” suggesting Sibal “thinks that he can sermonise the MPs and then go back to court” rather than focusing on parliamentary duties.

Kapil Sibal’s “inexplicable interest” in defending Justice Varma, despite the visible evidence of unaccounted money, has led to calls for a thorough investigation into his actions.

The minister’s comments, particularly regarding Kapil Sibal’s “judicial competence,” underscore a broader concern: the alleged use of “old, aged lawyers” to facilitate bribes, leading to a stark disparity in justice. Critics argue that while rich accused individuals easily secure bail, the poor languish in jails without trial. Once granted bail, affluent politicians often treat it as a “virtual acquittal,” rarely returning to custody.
This perceived distortion of the justice system is frequently cited with examples of high-profile politicians like Rahul Gandhi, Sonia Gandhi, P. Chidambaram, D.K. Shivakumar, Hemant Soren, Arvind Kejriwal, and Manish Sisodia, all of whom are currently out on bail despite facing “grave allegations.”
Justice Varma’s Legal Battle and Impeachment Proceedings
Justice Yashwant Varma of the Allahabad High Court has escalated his fight to the Supreme Court, challenging the findings of an inquiry committee that recommended impeachment proceedings against him. He seeks to quash the three-judge committee’s report, arguing that the proceedings violated his fundamental rights, and has urged the Supreme Court to set aside the impeachment recommendation made by former Chief Justice of India Sanjiv Khanna.
Following the controversy, Justice Varma was transferred from the Delhi High Court to the Allahabad High Court and stripped of all judicial duties. An impeachment motion against him is expected to be introduced during the upcoming Monsoon session of Parliament, commencing July 21.
